Per the Ohio DOA, "Auction" means a method of sale of real or personal property, goods, or chattels at a predetermined date and time using verbal exchange, regular mail, telecommunications, the internet, an electronic transmission, or a physical gesture between an auctioneer and members of the audience or prospective purchasers, the exchanges and gestures consisting of a series of invitations for offers made by the auctioneer and offers by members of the audience or prospective purchasers, with the right to acceptance of offers with the auctioneer. "Auction" includes a sale of real or personal property, goods, or chattels in which there has been a solicitation or invitation by advertisement to the public to advance the bids. A" deal or no deal" offering is an auction if multiple offers are entertained and the seller rejects or accepts the offers at a predetermined date and time.
“Live Auction” means an auction hosted by an auctioneer in real time.
“Online Auction” means an auction or sale at auction of real or personal property conducted via a website or similar interactive communication media in which the website or similar interactive communication media accepts and rejects bids and declares items, parcels or lots sold.
An auction firm is a person (or people) who provides auction services. It can manage, arrange, sponsor, contract for, take consignments, and handle monies for a personal property auction online or in person. A licensed auctioneer (not a firm) must conduct the bid calling if it is a live auction. An auction firm can only sell personal property.
Auction firms must attend an approved auction school, secure a $25,000 surety bond or irrevocable letter of credit and pass a background check to apply for the auctioneer license. They must then pass a written exam. A fee is required to take the test to obtain the permit, and Continued Education is necessary to maintain the license.
An auction mediation company is defined as a company that provides a forum through the Internet for a person to sell the person’s real or personal property via the submission of silent bids using a computer or other electronic device. An auction mediation company offers an online forum for the auction firm or auctioneer to sell property at auction online. It is the virtual equivalent of a person renting a building to another to conduct auctions. An auction mediation company is merely providing the platform and not conducting auctions. An auction firm provides auction services.
In Ohio, auction services arrange, manage, and sponsor a personal property auction. “Auction services” includes the taking and advertising personal property on consignment to be sold at an online or live auction by a licensed auctioneer for a fee or other consideration. It is everything but the verbal bid calling at a live personal property auction.
A commission is a fee that an auctioneer or auction firm receives for providing online auction services such as consignment, estate sales, liquidations, etc. It is generally a percentage of the total amount raised from the sale and can vary depending on the state and the auctioneer or auction firm. At Two Old Souls, Inc., we use a sliding scale to calculate our commission, considering the number of items to be sold, the type of items, the client’s timeframe, and the pickup location. Remember that this commission is used to pay credit card processing fees, our staff and our website fees. The 12% buyer's premium does not go to us; it goes to the platform owner. The buyer's premium is a percentage added to the final bid price of the sale/auction win. This fee typically goes to the auction platform owner to cover the costs of running the auction platform. The buyer's premium is currently 12% and is applied to your total purchase amount before taxes.
In online auctions, proxy bidding is a feature that allows bidders to set the maximum price they are willing to pay for an item. The auction system then automatically places bids on their behalf in the lowest possible increments up to the maximum amount. Proxy bidding aims to win the item at the lowest possible price.
The summary at the top of each auction provides the pickup date and general location. If you are the auction lot(s) winner, you will be provided the exact property address via email with your invoice immediately following the auction close. Please make all attempts to bid on our online auctions only if you can make the pickup date/time listed under "auction details" above the first page of items.
We understand that things happen, and you may not be able to make the pickup due to an unforeseen event; please call or email us to make other arrangements—we will do our best to accommodate you. If you cannot make it, you can contact us to see if we can arrange an appointment before bidding.

“We” refers collectively to Two Old Souls, Inc. and J&K Estates Sales LLC unless otherwise stated. The terms winners/buyers/winning bidders and items/lots/assets are used interchangeably for purposes of this document. Two Old Souls, Inc. is a
privately held corporation affiliated with J&K Estate Sales, its own operating
legal entity/business. J&K Estate Sales LLC and Affiliates are licensed and
bonded in favor of the State of Ohio.
1. BUYERS PREMIUM: 12%
2. REGISTRATION: Bidders MUST enter a valid Visa, MasterCard, Discover or American Express card with required contact information such as name, address, valid email and phone number. Note: we DO NOT automatically charge credit cards for invoiced amounts after the auction closes – the winning bidder must initiate and process any charge to their card for payment.
An Ohio resident must bid on a vehicle and other titled assets unless approved and granted permission by the auction firm manager or auctioneer ahead of time. Out-of-state bidders must contact the auction firm manager/auctioneer before bidding on titled assets; the platform admin will grant or deny approval on a case-by-case basis.
3. PAYMENT: Shortly after an auction concludes, the winning bidders will receive an invoice via the auction platform. Winners can pay online with a credit/debit card through Stripe via the J&K Estates auction platform or Square on the pickup day. A small processing fee (usually 5% or less) will apply to every online transaction. Cash will only be accepted at pick-up (small bills only, please), and checks are NOT accepted at any time.
4. SALES TAX: Two Old Souls, Inc. adds a 7% sales tax (Portage County) to every transaction on most auctions. The auction listing will expressly state that we are NOT charging sales tax for an auction when applicable.
5. BIDDING ERRORS: Please be aware that many bidders routinely increase their own bids to price an item out of reach of other bidders. Be sure to review ALL bids before submitting them, as we WILL NOT reverse bids that have caused another bidder to be outbid or if a bidder places a bid on the wrong item. We WILL NOT reverse any bids after the auction has begun to close, with no exceptions.
6. MAXIMUM BIDS: We usually use only one bidding field. MANY bidders submit their "maximum bids" as they appreciate the convenience and do not want to miss out on a bidding opportunity by placing only real-time bids (especially in the final frantic minutes of an auction). Please note that max bids are not disclosed.
The platform software will place your bid to your assigned max if someone bids against you. If you are immediately outbid when that bid is placed, you are most likely up against someone else’s max bid. Be sure to click "REFRESH LINK" often to ensure you see the most current data.
7. GROSS BIDDING ERRORS: Any gross errors must be reported immediately via phone call to (330) 283-0571. They will be handled on a case-by-case basis and at the sole discretion of J&K Estate Sales LLC and Two Old Souls, Inc., who are not obligated to make a reversal but will have the final decision on how to handle the situation.
8. STAGGERED CLOSING: Online auctions on this platform close one - two lots at one-minute intervals.
9. DYNAMIC CLOSING: An asset's closing time is automatically extended an additional two minutes whenever a new bid is placed within the last two minutes of the lot’s/item’s closing time to allow other bidders to place their final bids. This process will continue until all bidding on a lot/item ceases.
10. REMOVAL: This is an ONLINE-ONLY AUCTION. Please DO NOT bid if you cannot pick up your items during the indicated removal time. Please be aware that REFUNDS OR CHARGEBACKS WILL NOT BE GRANTED. Winners are responsible for their own removal of lots/items at their expense, liability, and risk. Winners are responsible for removing all items in each lot. The auction company staff does not provide moving services or tools. Please be prepared to move ALL items out of the building first, then pack and sort your items.
11. PICKUP OF ASSETS:. Winners will check in with the cashier to verify payment and/or pay in full and receive a copy of their invoice. All bidders agree to be held personally responsible for all purchases made on their bidder number or account and will not charge back items not picked up during the published removal times. The buyer authorizes J&K Estate Sales LLC and Two Old Souls, Inc. to release the buyer's assets to any individual possessing the buyer's sales receipt.
Buyers may be required to produce ID for security reasons. Please have your ID with you at all times at pickup. All Buyers accept that pickup may be electronically recorded and monitored, whether disclosed or not.
The Two Old Souls, Inc. warehouse pickup address is 1042 Wooster Rd North Barberton, Ohio 44203. If the pickup is not at our warehouse, the exact property address will be listed on the winner’s invoice, along with any special instructions. For the property owner's safety, only the general location of the property is disclosed in the auction details during the live online auction.
12. WARRANTY & CONDITION OF ITEMS SOLD: All items are sold "AS IS, WHERE IS, with NO WARRANTY expressed or otherwise implied. Descriptions are believed to be accurate but not guaranteed or always exact. Use the photos and your own eye as the determining factor when accessing an item’s condition or branding. When unsure of the condition or brand, please bid accordingly. J&K Estate Sales LLC and Two Old Souls, Inc. are not responsible for using or misusing items, infestation and pathogens, environmental or toxic harm or any injury or harm caused by items purchased.
13. BUYER DEFAULT: After the scheduled removal, items not picked up will be considered abandoned. We may charge your credit card or invoice you for a disposal fee for lots not picked up or items left behind at the property. If a bidder(s) defaults at an auction, at its discretion, it can contact the backup bidder(s) for an offer but is not legally obligated to do so.
